This key tax department position will report directly to the Senior Director, International Tax and interface with finance & operational leadership throughout the Company. This is both a strategic and tactical role, integral to the Company’s effective tax rate reduction strategy activities. There will be significant interaction with the accounting, finance, treasury, sales and marketing, and business operations groups.
This role will be responsible for managing global transfer pricing planning, implementation, compliance, and tax controversy activities. Detailed efforts include establishing & executing optimal intercompany pricing policies, pricing algorithms, documentation including intercompany agreements, and audit defense for tangible and intangible product transfers, services, shared service activities, and debt.
Essential Duties and Responsibilities
Conducting in-depth research, analysis, and direction for potential tax exposures related to (a) transactions; (b) operations; (c) mergers, acquisitions, & dispositions; and (d) other areas with significant transfer pricing consequences
Prepare periodic forecasts and establish transfer prices for intercompany transactions
Analyze current and future transfer pricing actions to help mitigate risk, optimize efficiency and facilitate future business operations
Participate in the global tax planning process and actively participate in the design and implementation initiatives
Develop planning initiatives that selectively enhance entity profitability
Manage transfer pricing models to compute and analyze intercompany transfer pricing adjustments affecting the quarterly and annual tax provision
Determine annual documentation requirements and costs effectively manage all relevant audit ready transfer price studies and contemporaneous documentation as required in all countries in which Company operates in accordance with both IRS and OECD guidelines
Keep apprised about US and global transfer pricing developments and their impact on the Company's structure including BEPS
Partner with individuals both within and outside tax to achieve corporate objectives with a transfer pricing impact
Monitor legal entity profitability to ensure compliance with US and non-US transfer pricing requirements, recommending and providing guidance for structural or transactional improvements or one-time adjustments to ensure ongoing compliance with policy and requirements
Monitor compliance with Transfer Price policies globally
Develop Transfer Pricing policies for tangibles and intangibles that align with Company objectives and deliver optimal profitability within legal entities in relation to functions performed and risks assumed
Controversy & Examinations
Develop and implement audit strategies including timely and complete responses to all Information Documents Requests (IDR’s), preparing memoranda supporting the company’s position, and helping draft protests for all un-agreed audit issues to minimize additional tax, interest, and penalty assessments
Maintain adequate documentation for potential future audits
Coordinate and monitor local country inquiries and exam developments
Assist in special transfer pricing projects including but not limited to Advanced Pricing Agreements, acquisitions, divestitures, legal settlements and litigation
Understand and proactively identify, quantify, and communicate the ASC 740 (FIN 48) implications associated with international tax positions and execution
Understand and implement updates and refinements to the international transfer pricing structure, including the intercompany accounting consequences and how to transact business between domestic and foreign affiliates
Provide attest firm auditors with sufficient documentation and analysis to support tax positions, calculations, and financial statement disclosure requirements
Work with International and Tax Reporting leaders and VP Tax to help minimize worldwide effective tax rate and cash taxes paid
Identify process improvements, implement changes and ensure best practices
Manage budget with external advisers.
Train and mentor junior staff for further development within the Tax Department
Develop relationships with Business leaders and their staff to provide guidance and ensure that business decisions consider tax impacts
Proven track record developing & implementing value enhancing global tax planning initiatives. Significant experience designing, feasibility testing, implementing, & maintaining tax optimized supply chain principal structures
Knowledge and experience with SOX 404 procedures and controls involving multinationals
Experience in medical device or high technology industries and Oracle ERP systems is desirable
Ability to develop, modify, and execute company policies that affect tax operations and impact other functional groups
Ability to succinctly communicate in writing, effectively interact, and explain complex tax issues in straightforward language to business and finance senior management
Ability to independently and simultaneously lead multiple projects
Very strong project management skills, including efficiently leading and managing internal and external resources, ability to work effectively with senior leaders in Business and Corporate functions
Robust leadership and communication skills; typically leading cross functional projects
Ability to effectively multi-task in a fast paced environment with a strong process orientation
Ability to collaborate in a team environment and professionally develop assigned personnel
Ability to act as primary contact on assigned engagements and successfully interact with professionals at all levels
- Bachelors & advanced degree (MS in Tax or MBA) or professional certification (e.g. CPA) preferred
- At least 5 years progressive experience in either public accounting firm or at a multinational organization with at least two years exclusively focused on international tax including transfer pricing planning, compliance, and controversy matters in multiple countries throughout Europe, Asia, and the Americas
